Solved.
I just upgraded to .D40 and boom. all working as expected.
so I assume was a bug.
current setup is now:
eBGP for POD underlay.
iBGP of POD overlay with spines as RR.
interpod direct links using eBGP underlay/overlay.
works a treat.
